1. Identity of the entrepreneur

Barna Lovers is a sole proprietorship registered on behalf of Dieter Covent, owner and representative. Barna Lovers acts as a Destination Management Company (DMC) and local partner for individual travellers, groups and companies. The organisation offers tailor-made activities, tours and events in and around Barcelona.

2. Applicability

These general terms and conditions apply to all quotes, bookings, agreements and services offered by Barna Lovers, both to consumers (B2C) and businesses (B2B), regardless of whether the customer is based in Belgium, the Netherlands, Spain, another EU country or outside the EU. By confirming a booking, the customer indicates that they have read and accepted these general terms and conditions.

3. Quotations and prices

All quotations and price quotes are without obligation until confirmed in writing by the customer. Prices are quoted in euros (€) and include VAT, depending on the VAT liability of the service, as stated in the quotation. However, prices are always subject to change. Any additional costs (transport, entrance fees, meals, etc.) will be clearly communicated in advance.

4. Booking and payment

The booking is finalised as soon as the customer has confirmed Barna Lovers' offer in writing. This is usually done by email, WhatsApp or Messenger. The agreement is not concluded by sending a request by email, nor by completing the online booking form or any other form. A booking is only considered to have been made after mutual agreement between Barna Lovers and the customer, once the booking has been confirmed in writing by email by Barna Lovers to the customer and after receipt of the agreed deposit or full payment. After the agreement has been concluded, the customer will receive a confirmation with practical information.

Terms of payment (unless agreed otherwise):

  • Deposit: 30% of the total amount upon confirmation;

  • Balance: no later than 30 days before the start of the activity.

For bookings made less than 14 days before the start date, the full amount must be paid immediately. This must be demonstrated by means of an official proof of payment. Payments are made by bank transfer or another agreed means of payment.

5. Cancellation by the customer

The customer always has the right to cancel. Cancellations must always be notified in writing (by e-mail) as soon as they become known to the customer. Depending on the nature of the service (e.g. bike tour vs. package tour), the notification period and the validity of the reason given, the following conditions apply.

SEPARATE SERVICES (e.g. bike tour, walk, wine tasting, etc.)

  • In the event of an unforeseen situation or valid reason on the part of the customer, cancellation is possible up to 24 hours in advance with a full refund. This is only possible if communicated in writing (by email) and in good time (as soon as known and up to 24 hours before the start of the booked tour, activity or event) to dieter@barnalovers.be. Such cancellations with a full refund are only possible after consultation with Barna Lovers and in agreement with the customer. They do not constitute an acquired right.

  • The date on which the written cancellation is received by Barna Lovers is considered the cancellation date. Cancellation is done individually per traveller, or on behalf of the traveller.

  • In the event of heavy rain or storm, the tour will be rescheduled to another date or time. If rescheduling is not possible, a full refund of the amounts already paid will be provided. In the event of light rain, the tour will go ahead, as rain showers in Barcelona are often short-lived. If you do not show up without prior notice, no refund will be possible.

  • In the event of a no-show, no refund of amounts already paid will be provided.

PACKAGES (e.g. group travel, multi-day packages, etc.)

  • The traveller always has the right to cancel a travel package booked with Barna Lovers. Such cancellation must always be communicated in writing (by email) and in a timely manner (as soon as known) by email to dieter@barnalovers.be. In the first instance, Barna Lovers will seek the most suitable solution in consultation with the customer.

  • The date on which the written cancellation is received by Barna Lovers will be considered the cancellation date. The cancellation must be made individually by each traveller or on behalf of the traveller.

  • The cancellation costs are calculated on the basis of the travel sum excluding the administration costs, handling fee and the premiums for cancellation and travel assistance insurance.

CANCELLATION COSTS:

  • Up to 30 days before departure: 30% of the total amount

  • 29 to 15 days before departure: 50% of the total amount

  • 14 to 7 days before departure: 75% of the total amount

  • 6 days or less before departure: 100% of the total amount

  • In case of no-show, no refund of amounts already paid will be provided.

6. Cancellation by Barna Lovers

Barna Lovers reserves the right to cancel an activity or package in the event of force majeure (e.g. extreme weather conditions, strikes, illness, safety risks or other unforeseen circumstances that were not known or could not be anticipated in advance).

In the event of cancellation by the organiser, the customer will be notified immediately by email. Barna Lovers will first seek the most suitable solution in consultation with the customer, namely: moving the booking to an alternative date, transferring the booking to another service or package, or a full refund of amounts already paid.

7. Changes

Minor changes to the programme that are necessary for the proper execution of the activity do not entitle the customer to cancellation or compensation. If a substantial change is necessary, the customer will be notified as soon as possible and may choose between an adjustment, an alternative activity, or cancellation with a full refund.

8. Liability

Participation in Barna Lovers tours, activities, and events is always at your own risk. Barna Lovers is not liable for:

  • Damage, loss or theft of personal belongings;

  • Physical injury or accidents, unless caused by intent or gross negligence on the part of Barna Lovers;

  • Misconduct, disruptive or dangerous behaviour on the part of the customer.

The customer is responsible for taking out the necessary and appropriate travel insurance and/or cancellation insurance prior to each tour, activity or event.

9. Customer behaviour

Customers are expected to act and behave respectfully:

  • The customer must follow the instructions of the guide or supervisor.

  • The customer must correctly follow all legal rules imposed by the Ajuntament de Barcelona and the Generalitat de Catalunya.

  • Customers are asked to be as considerate and respectful of the local population as possible.

  • Misconduct, disruptive or dangerous behaviour may result in immediate termination of the activity without entitlement to a refund. Barna Lovers cannot be held liable for the customer's behaviour and any consequences thereof.

10. Visual material

During tours, activities and events, Barna Lovers may take visual material for promotional purposes (see the “Privacy Statement” section on the website). If the customer does not wish to appear recognisable in the images, this must be reported in advance in writing by email to dieter@barnalovers.be.

11. Force majeure

Force majeure is understood to mean: any circumstance beyond the control of the parties that temporarily or permanently prevents the fulfilment of the agreement, such as war, pandemic, natural disaster, strike, government measures, technical malfunctions, etc.

12. Applicable law and competent court

All agreements are governed by Spanish law. Disputes will be submitted to the competent court in Barcelona, unless mandatory consumer law prescribes another court.
